Article 2: General provisions
These General Conditions of Sale (CGV) govern the sales of products or services, made through the website www.madoaparis.com, and are an integral part of the Contract between the Buyer and the Seller. They are fully opposable to the Buyer who accepted them before placing an order.

For the delivered products, the delivery will be made to the address indicated by the Customer. Article 5: Products and services

Article 7: Delivery terms
Mado in Paris dispatches the products present on the website www.madoaparis.com at home in mainland France and Monaco to the delivery address which was indicated when ordering and within the time indicated via the provider chronofood for the products fresh and perishable.

Mado à Paris reserves the right to use the telephone number entered in the order to complete the delivery information if it turns out to be incomplete.
Orders indicating a PO box address cannot be taken into account or processed.
When confirming the order, the customer must choose his delivery method. The customer will be asked for the desired delivery day for all modes of transport. Mado in Paris will make every effort to deliver the day and the time slot requested by the customer. Mado à Paris reserves the right to modify the delivery day and time for logistical reasons while informing the customer beforehand via the contact details that the customer will have informed when ordering. In the event of delay in shipment, Mado in Paris undertakes to inform the customer via the contact details that the customer will have informed when ordering. If the delivery has been validated by courier, Mado in Paris will ask to choose a theoretical slot of two hours. The courier reserves the right in the event of force majeure, strikes, exceptional days (public holidays, Christmas, New Year's Day) to deliver in an exceptional manner within a 3-hour slot before or after the time chosen by the customer. Working days for carriers: Wednesday to Saturday, excluding holidays.
The delivery times displayed on the website do not take into account the time required to prepare the order.
In the absence of the recipient to receive the products during delivery, the carrier will deposit a calling card to re-schedule a second and last delivery as far as access to the mailbox is possible. If the delivery has been validated by the customer by courier in Paris and the Customer is absent to receive the products, they will be returned to the departure shop. Mado in Paris will contact the Customer via his contact details left when ordering. In the event of late delivery due to the carrier or the Seller, the Customer has the possibility of terminating the contract under the terms and conditions defined in Article L 216-2 of the Consumer Code. The Seller then reimburses the product and the “outward” costs under the conditions of the provisions of articles L216-3 and L241-4 of the Consumer Code. The Seller provides a telephone contact point (cost of local communication from a landline) indicated in the order confirmation email in order to follow up on the order.
The Seller recalls that when the Customer physically hangs possession of the products, the risk of loss or damage to the products is transferred to him. It is the Customer's responsibility to notify the carrier of any reservations regarding the product delivered. The Customer agrees to report any problems or information concerning its delivery within 12 hours with proofs (photos) to be delivered again or to benefit from a credit for a next order. Mado in Paris will not reimburse the client but a solution will be offered to him.
Article 8: Availability and presentation
In case of unavailability of a product for a period greater than 5 working days, you will be immediately notified of the foreseeable delivery times and the order of this article may be canceled on request. The Customer may then request a credit for the amount of the article or its full refund and the cancellation of the order.
Article 9: Payment
Payment is due immediately upon order, including for pre-order products. The Customer can pay by payment card only (Mastercard, Visa, American Express or Maestro). Cards issued by banks domiciled outside France may undergo a percentage increase on the total amount of the order. Secure online payment by credit card is made by our payment provider Stripe.
The information transmitted is encrypted in the rules of the art and cannot be read during transport over the network. Once the payment has been initiated by the Customer, the transaction is immediately debited after verification of the information. In accordance with the provisions of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By communicating his bank information during the sale, the Customer authorizes the Seller to debit his card for the amount relating to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or if it is impossible to debit the card, the Sale is immediately automatically resolved and the order canceled.
Article 10: withdrawal period
In accordance with the provisions of article L 221-5 of the Consumer Code, the Buyer has the right to withdraw without giving any reason, within fourteen (14) days from the date of receipt of his order. We inform Customers that in accordance with the provisions of articles L. 221-18 to L. 221-28 of the Consumer Code, this right of withdrawal cannot be exercised for:
Supply of goods made according to the consumer's specifications or clearly personalized such as personalized Mados, personalized compositions made by the customer, custom-made pastries
Supply of goods likely to deteriorate or expire quickly such as madeleines, cakes, cookies, marshmallow, jams, spreads, ice cream, sorbets
Supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
Supply of goods which, after having been delivered and by their nature, are inseparably mixed with other articles;
In the event of exercise of the right of withdrawal within the above-mentioned period, the price of the product (s) purchased and the shipping costs will be reimbursed, the return costs remaining the responsibility of the Customer. Product returns must be made in their original condition and complete (packaging, accessories, instructions, etc.); if possible, they must be accompanied by a copy of the proof of purchase. Article 11: Guarantees, claims and reimbursement
In accordance with the law, the Seller assumes the guarantees of conformity and relating to hidden defects in the products. Mado à Paris guarantees the customer that the products are produced and packaged according to strict rules, and stored in accordance with the standards in force in France.
We inform on the website of the optimum storage conditions and the expiry date. If these are not respected by the customer, Mado in Paris cannot extend its warranty on its products.
The Customer must ensure the conformity of the order upon delivery. Any complaint will be valid only if it has been made within 48 hours of receipt, taking into account the perishable nature of the products.

Article 12: Complaints and mediation
If necessary, the Purchaser may submit any complaint by contacting the company using the following contact details by email to firstname.lastname@example.org or by phone on 09 54 65 87 02.
In accordance with the provisions of art. L. 611-1 to L. 616-3 of the Consumer Code, the consumer is informed that he can have recourse to a consumer mediator under the conditions provided for in Title I of Book VI of the Consumer Code.
In the event of failure to submit a claim to the Seller's customer service, or in the absence of a response within two months, the consumer may submit the dispute to a mediator who will attempt to bring the parties together independently to obtain an amicable solution.
Article 13: termination of the contract
The order can be resolved by the buyer by registered letter with request for acknowledgment of receipt in the following cases:
Delivery of a product not conforming to the characteristics of the order
Delivery exceeding the deadline set when ordering or, failing that, within thirty days of payment
Unjustified price increase or modification of the product.
In these cases, the buyer can demand the refund of the deposit paid plus interest calculated at the legal rate from the date of receipt of the deposit.
Article 14: Intellectual property rights
The Mado in Paris brand, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of Mado in Paris. No transfer of intellectual property rights is made through these GTC. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.
Article 15: Force majeure
The execution of the seller's obligations hereunder is suspended in the event of a fortuitous event or force majeure which would prevent its execution. The seller will notify the customer of the occurrence of such an event as soon as possible.
Article 17: Nullity and modification of the contract
If one of the stipulations of this contract is canceled, this nullity would not result in the nullity of the other stipulations which will remain in force between the parties. Any contractual modification is only valid after a written and signed agreement of the parties.
Article 16: Protection of personal data
In accordance with Regulation 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the Seller sets up a processing of personal data which has for finality the sale and delivery of products and services defined in this contract. The duration of data storage: the time of commercial prescription
The data subject has the right to ask the data controller for access to personal data, rectification or deletion thereof, or a limitation of the processing relating to the data subject, or the right to object the processing and the right to data portability. Article 19: Applicable law and clauses
All the clauses appearing in these general conditions of sale, as well as all the purchase and sale operations which are referred to therein, will be subject to French law. The commercial court of Paris will be the only competent for any litigation or different concerning them.
The nullity of a contractual clause does not invalidate these general conditions of sale.
